COOKIES

Cookies are small text files that websites send to the user's terminal (usually the browser), where they are stored before being retransmitted to the same websites the next time the same user visits them. In addition to cookies, other similar tools (web beacons/web bugs, clear GIFs, or others) that allow the user or terminal to be identified are also subject to the provisions of the Italian Data Protection Authority.

While browsing a website, the user may also receive cookies on his or her terminal that are sent from different websites or web servers (so-called "third parties"), which may contain certain elements (such as, for example, images, maps, sounds, specific links to pages on other domains) present on the website he or she is visiting.
Cookies, usually present in users' browsers in very large numbers and sometimes with characteristics of long persistence in time, are used for different purposes: performing computer authentication, monitoring sessions, storing information on specific configurations regarding users accessing the server, etc. Further information on cookies can be found at www.allaboutcookies.org .

In order to properly regulate these devices, it is necessary to distinguish them, given that there are no technical characteristics that differentiate them from one another, based on the purposes pursued by those who use them. Moreover, the legislator has moved in this direction, implementing the provisions of Directive 2009/136/EC, by requiring users' prior and informed consent to install cookies used for purposes other than purely technical ones (see Article 1, paragraph 5, letter a), of Legislative Decree No. 69 of 28 May 2012, which amended Article 122 of the Code).
